Terms of Use

Last updated: October 15, 2026

These Terms of Use are an agreement between you and Prosperous Life MD, LLC (the “Company,” “we,” or “us”). They govern your access to and use of www.chartingconquered.com and every page, course, community, coaching session, download, email and other service we offer under the Charting Conquered® name (together, the “Services”), whether you are a visitor or a registered user.

By using the Services, or by clicking to accept these Terms when that option is offered, you agree to be bound by these Terms and by our Privacy Policy, which is part of these Terms. If you do not agree, do not use the Services. You must be at least 18 years old to use the Services.

1. Changes to These Terms

We may revise these Terms at any time. Changes take effect when we post them on this page, and the date above will show when they were last updated. Continuing to use the Services after a change means you accept the revised Terms.

2. Educational Purpose Only. Not Medical, Legal, Billing or Financial Advice

The Services teach documentation workflow, efficiency habits and mindset for clinicians. They are for educational and informational purposes only. Nothing in the Services is medical advice, a clinical standard of care, legal advice, coding or billing advice, compliance advice, or financial advice, and nothing in the Services creates a physician–patient or other professional relationship.

You remain solely responsible for your clinical judgment, your documentation, and your compliance with the laws, payer rules, licensing requirements and employer policies that apply to you. Before changing how you document, code or bill, check with your organization’s compliance, coding or legal resources as appropriate.

3. Do Not Share Protected Health Information

Do not submit protected health information (PHI) or any information that could identify a patient through any part of the Services, including forms, emails, community posts, coaching calls, chat, worksheets or note examples. Any note or example you share must be fully de-identified first. We are not a covered entity or business associate under HIPAA for your practice, and we do not accept PHI. If PHI is shared with us, we may delete it without notice.

4. Results and Testimonials

Testimonials, participant outcomes and program data shown in the Services reflect the experiences of specific participants and are not a guarantee or prediction of your results. Results depend on many factors, including your practice setting, specialty, schedule, EHR and how fully you apply the material. You are responsible for your own actions and outcomes.

5. Continuing Education Credit

Where continuing medical education (CME) or continuing education (CE) credit is offered in connection with the Services, it is provided through a third-party accredited provider under that provider’s own terms, eligibility rules and requirements. We do not award credit directly and cannot guarantee that any credit will be accepted by your licensing board, certifying body or employer.

6. Purchases, Payment Plans and Refunds

Prices, payment terms, access periods and refund eligibility for each program are stated on that program’s sales page and checkout page, and those product-specific terms form part of your purchase. If you choose a payment plan, you authorize all scheduled payments, and your obligation to complete them continues even if you stop using the program. We may pause or end access for unpaid balances.

Questions about a purchase or subscription can be sent to [email protected].

7. Your Account

You are responsible for keeping your login credentials confidential and for all activity under your account. Accounts are for one person and may not be shared. Tell us promptly at [email protected] if you believe your account has been accessed without permission. We may change, suspend or withdraw any part of the Services, or restrict access to it, without notice, and we are not liable if the Services are unavailable at any time.

8. Intellectual Property and Your License

The Services and all of their content, including videos, recordings, worksheets, templates, scripts, frameworks, text, graphics and trademarks such as Charting Conquered®, belong to the Company or its licensors and are protected by copyright, trademark and other laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the content you are entitled to for your own professional development. You may not copy, record, share, resell, republish, distribute, upload to an AI tool or dataset, teach from, or create derivative products from the content, or give anyone else access to it, without our written permission.

9. Community, Coaching and Live Sessions

If you take part in a community, group coaching call, live session or comment feature, you agree to treat other members with respect and to keep what other members share confidential. You may not post anything unlawful, harassing, defamatory or infringing, promote your own products or services without permission, or record sessions without our consent. We may record live sessions and make recordings available to participants. We may review, edit or remove any content, and may suspend or end access for anyone who violates these Terms.

10. Your Submissions

You keep ownership of what you submit, such as comments, questions, survey responses and success stories. You give us a non-exclusive, royalty-free, worldwide license to use, reproduce and display your submissions to operate and improve the Services. We will ask your permission before publishing your name or likeness with a testimonial. You will not be paid for submissions.

11. Third-Party Services and Links

The Services run on and link to third-party platforms, such as our course platform, payment processors, video tools and continuing education providers. We are not responsible for their content, policies or performance, and your use of them is governed by their terms.

12. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or free of harmful components.

13. Limitation of Liability

To the fullest extent permitted by law, the Company and its owners, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of income, data or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the claim arose.

14. Indemnification

You agree to defend, indemnify and hold harmless the Company and its owners, employees, contractors and agents from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your use of the Services, your clinical or business decisions, or your violation of these Terms.

15. Disputes, Arbitration and Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be resolved by binding arbitration on an individual basis in Minneapolis, Minnesota. You waive any right to bring or join a class action or class arbitration. Either party may seek temporary injunctive relief in court to protect intellectual property.

16. Termination

We may suspend or end your access to the Services at any time if you violate these Terms. The sections on intellectual property, disclaimers, limitation of liability, indemnification and disputes survive termination.

17. General

These Terms, together with the Privacy Policy and any product-specific terms shown at checkout, are the entire agreement between you and the Company about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship. If you access the Services from outside the United States, you are responsible for complying with your local laws.
